What is Trademark Renewal?
Trademark Renewal is the process of extending the protection of a registered trademark before or after the expiry of its last registration period, subject to the Trade Marks Act, Rules and prescribed fees.
How long is trademark registration valid in India?
A registered trademark is generally valid for 10 years and can be renewed from time to time for further 10-year periods by filing the renewal request and paying the prescribed fee.
Which form is used for Trademark Renewal?
Form TM-R is used for trademark renewal, surcharge request within the allowed post-expiry period and restoration plus renewal where the mark has been removed for non-payment of renewal fee.
When can Trademark Renewal be filed?
Under the Trade Marks Rules, a renewal request in Form TM-R can be filed not more than one year before the expiration of the last registration of the trademark.
What happens if renewal is not filed before expiry?
If renewal is not filed before expiry, renewal may still be possible within the permitted post-expiry period by filing the proper request with surcharge. If not handled in time, the trademark may be removed from the register.
Can a removed trademark be restored?
Yes, restoration and renewal may be requested in Form TM-R within one year from the expiration of the registration, subject to the Registrar considering the request and the interest of affected persons.
Does IP India send notice before trademark removal?
If no renewal application with fee is received, the Registrar sends a notice in Form RG-3 not more than six months before expiry at the address for service, informing the proprietor about the approaching expiration.
What details are required for Trademark Renewal?
Common details include trademark registration number, class, proprietor name, current status, certificate or eRegister copy, address for service, renewal due date, Power of Attorney if required and updated contact details.
Is fresh examination required for Trademark Renewal?
Trademark renewal is not the same as filing a new trademark application. The Registry checks renewal eligibility, status, prescribed form, fee and register-related issues before allowing renewal.
What if proprietor name or address has changed before renewal?
If proprietor name, address or ownership details have changed, record correction, assignment, transmission or address-update guidance may be required along with or before the renewal strategy.
Will I get a new certificate after renewal?
After renewal or restoration and renewal, the Registry sends notice of renewal or restoration and renewal, and the renewal is advertised in the Trade Marks Journal as per the Rules.
