No. Copyright comes into existence automatically when an original work is created. However, the registration certificate and entries in the Register of Copyrights serve as prima facie evidence in court for ownership disputes.
Which works can be registered under copyright?
Copyright registration can cover original literary, dramatic, musical and artistic works, cinematograph films and sound recordings. Computer software is generally registered as a literary work.
Does copyright protect ideas or only expression?
Copyright protects the expression of an idea, not the idea itself. It does not protect ideas, procedures, methods of operation or mathematical concepts as such.
Which form is used for Copyright Registration?
Application for copyright registration is made in Form XIV along with Statement of Particulars and Statement of Further Particulars, where applicable.
Can published and unpublished works be registered?
Yes. Both published and unpublished works can be registered if they are eligible and still enjoy copyright protection.
Can software or source code be copyrighted?
Yes. Computer software or computer programme can be registered as literary work, and source code and object code may be required with the application.
Can a website be registered as copyright?
A website as a whole is generally not registered as one work. Different copyrightable components such as text, photos, software code, database, videos or music may need separate applications.
Is separate application required for each work?
Yes. Separate applications should be made for registration of each work.
What is the waiting period after filing?
After filing and diary number generation, there is a mandatory waiting period of 30 days so that objections, if any, can be filed against the claim.
How long does Copyright Registration take?
In normal cases, after the 30-day waiting period, the application is examined. If no objection or discrepancy is pending, the process may take around 2 to 3 months, depending on the case and applicant response.
